These Terms of Use govern your access to and use of the Bayverak platform operated by Bayverak Pty Ltd ("Bayverak", "we", "us" or "our"). By submitting an access request or using the platform, you agree to be bound by these terms. Please read them carefully before proceeding.

1. Platform access

Access to the Bayverak platform is available through a guided access-request process. Bayverak Pty Ltd reserves the right to review, approve or decline any access request at its sole discretion. Access to the platform does not create any entitlement to continued use or to specific platform outcomes.

2. Permitted use

You may use the Bayverak platform solely for lawful purposes and in accordance with these terms. You agree not to:

  • Use the platform in any way that violates applicable Australian or international law
  • Attempt to gain unauthorised access to any part of the platform or its underlying systems
  • Introduce malicious code, automated bots or any material that disrupts platform operation
  • Submit false or misleading information in the access-request process
  • Reproduce, distribute or commercially exploit platform content without written permission

3. Platform content and outputs

The structured outputs and automated insights provided by the Bayverak platform are generated based on the information submitted and are intended for informational and review purposes only. Bayverak does not guarantee the accuracy, completeness or fitness for any particular purpose of platform outputs. Users are responsible for independently verifying any information obtained through the platform before acting on it.

4. Intellectual property

All content, software, design elements and platform architecture associated with Bayverak are the intellectual property of Bayverak Pty Ltd or its licensors. You are granted a limited, non-exclusive, non-transferable licence to access and use the platform for your own personal or internal business purposes. No other rights are granted.

5. Limitation of liability

To the maximum extent permitted by applicable law, Bayverak Pty Ltd shall not be liable for any indirect, incidental, consequential or special damages arising from or related to your use of the platform, including reliance on platform outputs. Our total liability for any claim related to the platform shall not exceed the amount you paid, if any, for access to the platform in the preceding twelve months.

6. Termination

Bayverak Pty Ltd may suspend or terminate your access to the platform at any time, with or without notice, if you breach these Terms of Use or if we determine that termination is necessary for the security or integrity of the platform. You may request termination of your access at any time by contacting the support team.

7. Changes to these terms

We may update these Terms of Use from time to time. When changes are made, the revised terms will be published on this page. Your continued use of the platform after changes are published constitutes acceptance of the updated terms.

8. Governing law

These Terms of Use are governed by the laws of the State of Victoria, Australia. Any disputes arising in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Victoria.
